End unlawfulness against human rights activist and deputy Gergerlioğlu!

HDP Deputy Ömer Faruk Gergerlioğlu was sentenced to 2 years and 6 months in prison for “making propaganda for a terrorist organization” on the grounds that he shared on his twitter account an article from T24 news website. Due to this decision, we are faced with the unlawfulness of Gergerlioğlu’s deputy and arrested.

We, 203 persons and organisations (politicians, academics, artists, authors, journalists, and human rights advocates) demand that the unlawfulness against human rights activist and deputy Gergerlioğlu is immediately ended!

Le député du Parti démocratique des peuples (HDP), M. Ömer Faruk Gergerlioğlu, a été condamné à 2 ans et 6 mois de prison pour «propagande en faveur d’une organisation terroriste» au motif qu’il avait partagé un article du site d’information « T24 » sur son compte Twitter. À cause de ce jugement, nous sommes confrontés à une illégalité face au statut parlementaire de M. Gergerlioğlu qui sera déchu ainsi qu’à son arrestaion.

En tant que politiciens, avocats, universitaires, artistes, écrivains, journalistes et 203 personnes et institutions sensibles aux droits humains, nous voulons mettre fin à l’injustice contre le militant des droits humains et député M. Gergerlioğlu

Open Letter to President Erdoğan

Solidarity with Human Rights Activist and Member of Parliament Ömer Faruk Gergerlioğlu

Your Excellency,

The International Observatory of Human Rights joined by the below human rights organizations, and esteemed members of civil society, are writing this letter to express our concerns about the current pressures imposed by the state of Turkey upon countless individuals especially Mr. Ömer Faruk Gergerlioğlu, who is making tireless efforts to champion human rights in Turkey, and maintain institutions that are struggling to this end.

Gergerlioğlu, a human rights activist and an MP, was threatened with ‘terrorism’ charges, first by Uşak Police Chief and then by AKP Group Chairman Özlem Zengin and Interior Minister Suleyman Soylu.

The fact that 23 female students studying at Uşak University had been subjected to strip searches twice for 5 days after their detention on August 31, 2020 drew strong reaction on social media.

Mr. Gergerlioğlu expressed this news in the Parliament and called for an end to the unlawful practice of strip searches.

As the topic of strip searches grew on social media, with the women who suffered from this inhumane practice sharing what they had to endure with the public. Many champions of human rights supported the victims, categorically denouncing this unlawfulness which in no way is compatible with human dignity,

The strip searches conducted twice for supposed security reasons by the Uşak Police violate the prohibition of treatment incompatible with human dignity. Although an effective investigation into this issue was necessary, MP Ömer Faruk Gergerlioğlu, who brought it to the Parliament and also made it public, was even subjected to accusations.

AKP Group Deputy Chair Özlem Zengin targeted MP Gergerlioğlu, saying; “So far, I have never seen a deputy who terrorizes the Parliament as much as Mr. Gergerlioğlu.”

Shortly after this statement, Uşak Police Chief Mesut Gezer made the following statement containing threats and insults, saying: “We are here to fight with these treachers who slander us, these sanguinaries, bloodshedders, … We will not let them breathe in this country.”

Following this statement, Interior Minister Süleyman Soylu also pointed his fingers at Mr. Gergerlioglu, saying: “Indeed, this man is a terrorist, we have filed numerous complaints. I’m calling on the judiciary to do whatever is necessary about him. “

Immediately afterwards, Ankara Chief Public Prosecutor’s Office announced that an investigation was launched against Gergerlioğlu and the people who voiced their reactions on social media.

We would like to underline that we are seriously concerned about long-standing mass detentions and human rights violations in Turkey, public officials are easily accusing human rights defenders and MPs of being “terrorists”.

In light of the above the IOHR along with the below esteemed institutions and individuals stand in solidarity with Mr. Ömer Faruk Gergerlioğlu and we call on the authorities in Turkey to investigate and stop all threats directed by public officials, politicians and prosecutors at Mr. Gergerlioğlu and other human rights defenders.

Lettre ouverte au Président Erdoğan

Solidarité avec le défenseur des droits humains et député Ömer Faruk Gergerlioğlu

En tant qu’International Observatory of Human Rights (IOHR) et organisations de défense des droits humains, militants, avocats, écrivains, journalistes, politiciens et universitaires, nous écrivons cette lettre pour exprimer nos préoccupations concernant les pressions actuelles infligées à tous les individus et à toutes les institutions, en particulier à M. Ömer Faruk Gergerlioğlu, qui fait des efforts inlassables pour les droits humains en Turquie.

Gergerlioğlu, militant des droits humains et député, a été menacé d’accusations de « terrorisme », d’abord par le chef de la police d’Uşak, puis par Özlem Zengin, vice-présidente du groupe parlementaire du parti au pouvoir AKP, et par Süleyman Soylu, Ministre de l’Intérieur.

Le fait que 23 étudiantes de l’Université d’Uşak avaient été soumises à des fouilles à nu deux fois au cours des cinq jours suite à leur mise en garde à vue le 31 août 2020 a suscité une vive réaction sur les réseaux sociaux. M. Gergerlioğlu a soulevé cette nouvelle au parlement turc et a demandé une fin aux fouilles à nu illégales.

Après que cette pratique soit devenue un sujet de débat sur les réseaux sociaux, d’autres femmes qui en souffraient ont partagé avec le public leurs expériences à travers des vidéos qu’elles ont publiées. Dénonçant catégoriquement cette pratique illégale qui n’est en aucune manière compatible avec la dignité humaine, de nombreux défenseurs des droits humains ont exprimé leur soutien pour les victimes.

Les fouilles à nu effectuées à deux reprises pour des raisons supposées de sécurité par la police d’Uşak violent l’interdiction des traitements incompatibles avec la dignité humaine. Bien qu’une enquête efficace sur cette question soit nécessaire, le député M. Gergerlioğlu, qui l’a portée au niveau parlementaire, a fait l’objet d’accusations.

Özlem Zengin, vice-présidente du groupe AKP, a pris M. Gergerlioğlu pour cible, disant que : « Jusqu’à présent, je n’ai jamais vu un député terroriser le parlement autant que M. Gergerlioğlu. »

Peu de temps après cette déclaration, Mesut Gezer, le chef de la police d’Uşak, a fait la déclaration suivante contenant des menaces et des insultes : « Nous sommes là pour lutter contre ces traîtres qui nous calomnient, ces sanguinaires … Nous ne les laisserons pas respirer dans ce pays. »

Suite à cette déclaration, le Ministre de l’Intérieur Süleyman Soylu a également pointé M. Gergerlioğlu du doigt : « En effet, cet homme est un terroriste, nous avons déposé de nombreuses plaintes. J’appelle la justice à faire tout ce qui est nécessaire à son sujet. »

Immédiatement après, le parquet général d’Ankara a annoncé l’ouverture d’une enquête contre les personnes ayant exprimé sur les réseaux sociaux leur réactions par rapport à la controverse.

Nous tenons à souligner que nous sommes gravement préoccupés par les détentions de masse et les violations des droits humains en Turquie ainsi que le fait que les fonctionnaires peuvent facilement accuser les défenseurs des droits humains et les parlementaires de « terrorisme ».

En tant qu’ IOHR et institutions qui croient aux droits humains et aux libertés et qui luttent à cette fin, nous sommes aux côtés de M. Ömer Faruk Gergerlioğlu et nous souhaitons une fin aux menaces dirigées par des fonctionnaires, des politiciens et des procureurs à l’égard des défenseurs des droits humains, en particulier de M. Gergerlioğlu.

Cumhurbaşkanı Erdoğan’a Açık Mektup

İnsan Hakları Aktivisti ve Milletvekili Ömer Faruk Gergerlioğlu ile Dayanışma

International Observatory of Human Rights (IOHR) ve aşağıdaki insan hakları kuruluşları, aktivistler, hukukçular, yazarlar, gazeteciler, politikaciler ve akademisyenler olarak bizler, bu mektubu Türkiye’de insan hakları konusunda bitmek bilmeyen bir caba gösteren başta Sayın Ömer Faruk Gergerlioğlu olmak üzere, bu amaç doğrultusunda çalışan kişi ve kurumlara karşı mevcut baskılar konusundaki endişelerimizi ifade etmek için yazıyoruz.  

Bilindiği üzere, insan hakları aktivisti ve milletvekili olan Gergerlioğlu, önce Uşak Emniyet Müdürü sonrasında da AKP Grup Başkanvekili Özlem Zengin ve İçişleri Bakanı Süleyman Soylu tarafından ‘terörist’ suçlamasında bulunularak tehdit edilmiştir.

Uşak Üniversitesi’nde okuyan 23 kız öğrencinin, 31 Ağustos 2020 tarihinde gözaltına alındıktan sonraki 5 gün boyunca iki sefer çıplak aramaya maruz kalmış olmaları, toplumda infial yaratan bir haber olarak sosyal medyada yer almıştır. Sayın Gergerlioğlu, bu haberi Meclis’te de dile getirilerek hukuka aykiri şekilde yapılan çıplak arama uygulamasına son verilmesi çağrısında bulunmuştur.

Çıplak arama uygulamasının sosyal medyada gündem olması üzerine, bu uygulamanın mağduru olan kadınlar, çektikleri videolar aracılığıyla yaşadıklarını tüm ayrıntılarıyla kamuoyu ile paylaşmışlardır.  Bu paylaşımlar sonrasında çok sayıda insan hakları savunucusu, hiçbir şekilde insan onuruyla bağdaşmayan bu hukuksuzluğa tepki göstermek suretiyle, mağdurlara destek olmuştur.

Uşak Emniyeti tarafından sözde ‘güvenlik araması’ adı altında hem de iki kez yapılmış olan çıplak arama uygulaması, insan haysiyeti ile bağdaşmayan muamele yasağını ihlal etmektedir. Bununla ilgili etkili bir soruşturma yapılmasının gerekliliğine rağmen, konuyu Meclise taşıyan Ömer Faruk Gergerlioğlu suçlamalara maruz kalmıştır.

AKP Grup Başkanvekili Özlem Zengin, “Ömer Faruk Gergerlioğlu kadar ben Meclis’i terörize eden başka bir milletvekili görmedim” diyerek, Gergerlioğlu’nu hedef göstermiştir.  

Bu açıklamadan kısa bir süre sonra Uşak Emniyet Müdürü Mesut Gezer, Milletvekili Ömer Faruk Gergerlioğlu hedef alan şu açıklamayı yapmıştır; “Bize iftira atan bu kalleşlere, bu kan dökücü, ağzından kandan başka hiçbir şey akmayan bu müfterilerle hukuk önünde adaletle mücadele etmek adına geldik… Onlara bu ülkede nefes aldırmayacağız. FETÖ’sü, PKK’sı kim gelirse gelsin, Türk Polisi burada!”

Bu açıklamanın ardından, İçişleri Bakanı Süleyman Soylu da “Üzerinde sadece milletvekili kılıfı var. FETÖ’nün sözleriyle bunu ifade etmektedir. Zihni bulanmış, aklı gitmiş. FETÖ teröristi olan… Açık söylüyorum. Ben buradan yargıya da çağrıda bulunuyorum. Hakikaten bu adam teröristtir, suç duyurusunda bulunduk defalarca. Gereği yerine getirilsin” diyerek Gergerlioğlu’nu hedef almıştır.

Bunun hemen akabinde, Ankara Cumhuriyet Başsavcılığı, Gergerlioğlu ve çıplak arama konusunda tepkilerini ortaya koyan kişiler hakkında soruşturma başlatıldığı açıklaması yapmıştır.

Kamu görevlilerinin insan hakları savunucularına ve milletvekillerine kolay bir şekilde ‘terörist’ suçlamasında bulunması nedeniyle, uzun süredir devam eden kitlesel gözaltılar ve insan hakları ihlalleri konusunda ciddi endişe içerisinde olduğumuzu belirtmek isteriz.

IOHR ve insan hak ve özgürlüklerine inanan, bu kapsamda mücadele eden kişi ve kurumlar olarak Sayın Ömer Faruk Gergerlioğlu’nun yanında olduğumuzu belirtiyor ve başta Gergerlioğlu olmak üzere insan hakları savunuculuğu yapan kişilere kamu görevlileri, siyasiler ve savcılar tarafından yöneltilen tehditlere son verilmesi çağrısında bulunuyoruz.
